Welcome to StoryCloud! These Terms and Conditions ("Terms", "Agreement") govern your use of the StoryCloud mobile application, website, and related services (together, the "Services"). By creating an account, subscribing, or allowing your child to use the Services, you agree to these Terms. If you do not agree, you must not use the Services.
1. About StoryCloud
StoryCloud Pty Ltd ("StoryCloud", "we", "us", "our") is an Australian company that provides interactive stories and educational media for children aged 2 to 9. Our Services are designed for families and early learning centres, blending imaginative storytelling with values-led learning. Because our Services are designed for young children, we require that all accounts are created and managed by adults (parents, guardians, or authorised educators).
2. Acceptance of Terms
You must be at least 18 years old and a parent, legal guardian, or authorised educator to accept these Terms.By subscribing, registering, or otherwise using the Services, you confirm that you have the authority to act on behalf of your child or the children in your care.If you are an early learning centre, you confirm that you have obtained parental or guardian consent for any child data you provide to us.3. Eligibility of Child Users
Children under 18 may use StoryCloud only under the supervision of a parent, guardian, or educator.Children cannot create accounts, enter into contracts, or provide consent themselves.You, as the parent, guardian or centre, are responsible for ensuring your child’s appropriate use of the Services.4. Educational Purpose and Limitations
StoryCloud is designed as an educational and entertainment tool. Content is aligned with the Early Years Learning Framework (EYLF) and informed by values of diversity, inclusion, and digital safety. StoryCloud is not a formal school or accredited educational provider. The Services supplement—do not replace—professional education or parental guidance.We do not guarantee specific learning outcomes.4A. CCS Alignment and Centre Delivery
Centre-delivered service. StoryCloud is delivered through participating Early Learning Centres as part of in-session educational delivery. It is not a separate care type and does not alter attendance marking or absence rules within CCMS.Digital Learning Levy (DLL) / CWA. may be itemised as a Digital Learning Levy (DLL) in the Complying Written Arrangement (CWA) and included in the session-of-care fee.CCS-aligned (no guarantees). StoryCloud is CCS-aligned. For eligible families, CCS may reduce out-of-pocket costs. StoryCloud does not determine CCS eligibility, rates, caps, hours, or entitlements and makes no guarantee that any fee will be subsidised.No inducements. StoryCloud does not offer gifts, prizes, or enrolment incentives. Delivery, marketing, and participation must remain inducement-free.App Plan (BYOD). The App Plan provides access to StoryCloud on a device the family already owns. No hardware is provided by StoryCloud under the App Plan.Learning Bundle (managed infrastructure). The Learning Bundle includes a managed iPad kit (e.g., device, rugged case, charger) provisioned for educational use during the program term and administered under mobile device management (MDM). The kit remainsStoryCloud property during the term. Any ownership option after completion, if offered, is discretionary and handled separately from enrolment and CCS.Shared Learning Extensions. Family engagement features may be available to support continuity of learning. These are optional and sit outside CCS-eligible delivery; centre delivery remains the CCS-aligned activity.5. Subscription and Payments
5.1 Subscription Plans
Families may access StoryCloud through individual subscriptions ("App Plan") or via early learning centres partnered with StoryCloud.When accessed via centres, fees may be included in the session-of-care fee via the Digital Learning Levy (DLL) (see §4A). CCS may reduce out-of-pocket costs for eligible families; no subsidy is guaranteed.5.2 Fees and Billing
Fees are disclosed at the time of subscription.By subscribing, you authorise us (or our payment processor) to charge applicable fees and taxes.Payments are subject to the terms of the chosen plan and processed by third-party providers.Billing practices comply with your rights under the Australian Consumer Law (ACL).5.3 Renewals and Cancellations
Subscriptions renew automatically unless cancelled.You may cancel at any time through your account or by contacting support.If access is provided via a centre and the CWA or DLL arrangement ends, access to the Services may cease accordingly.5.4 Refunds
Refunds are provided in accordance with the ACL and our Refund Policy.If we terminate your subscription without cause, we will provide a pro-rata refund of prepaid fees.Refunds do not apply to amounts paid or credited via a centre’s DLL unless required by law or expressly stated by the centre’s policy.5.5 Price Changes
We may update subscription prices. You will receive advance notice; continued use after notice constitutes acceptance of the new fees.6. Account Management
Parents or guardians are responsible for maintaining the confidentiality of login credentials. You must immediately notify us of any unauthorised use of your account. Accounts may not be shared beyond your household or authorised centre use.7. Content and Intellectual Property
7.1 Ownership
All content available through StoryCloud including videos, audio, text, illustrations, characters, software, and trademarks is owned by StoryCloud or our licensors.Characters, names, and designs are protected trademarks and may not be used without permission.7.2 Licence to Use
We grant a limited, revocable, non-exclusive licence to access and use the Services for personal, family, or authorised educational purposes only.You may not (i) copy, reproduce, or distribute content outside the Services; (ii) modify, reverse engineer, or create derivative works; (iii) use the Services for commercial purposes without written permission.Educators may project or print StoryCloud content for classroom purposes within the scope of their subscription.7.3 User-Generated Content
If features allow children to create material (e.g., drawings, recordings, customisations), such content remains private to your account unless you explicitly share it.You grant StoryCloud a limited licence to store and display that content solely to deliver the Services.We may use anonymised or aggregated user-generated content to improve the Services, ensuring it cannot identify you or your child.8. Acceptable Use
You agree not to: (i) hack, disrupt, or misuse the Services; (ii) upload malware or harmful code; (iii) use the Services for illegal purposes; (iv) attempt to extract or misuse children’s data. We may suspend/terminate accounts that violate these rules.
9. Privacy, Security, and Child Protection
Your use is subject to our Privacy Policy (incorporated by reference). Key commitments: (i) we collect minimal child information (first name, age, usage data); (ii) no third-party advertising and wedo not sell personal data; (iii) compliance with the Privacy Act 1988 (Cth) and theAustralian Privacy Principles (APPs); (iv) security measures such as encryption and access controls; (v) educator-guided usage and family transparency features.
10. Early Learning Centres
If you are a centre, you: (i) warrant valid parental/guardian consent before providing child information; (ii) use child data only for educational purposes consistent with StoryCloud’s values; (iii) comply with applicable laws, including the National Quality Framework (NQF) overseen by ACECQA.
11. Safety, Accessibility and Wellbeing
StoryCloud has no social media integrations, no public communication features, and no third-party advertising. Content is curated for age-appropriateness and aligned to the EYLF; alignment does not constitute regulator accreditation or endorsement. Parents and educators must supervise use and ensure a safe environment.
12. Availability and Service Changes
We aim for continuous, high-quality service but do not guarantee uninterrupted availability. We may update, modify, or discontinue parts of the Services at any time. If material changes affect your subscription, we will provide notice.
13. Disclaimer of Warranties
To the extent permitted by law: the Services are provided “as is” and “as available.” We make no warranties about specific learning outcomes, error-free content, or uninterrupted access. Suggested activities (e.g., crafts, experiments) must be done under adult supervision.
14. Limitation of Liability
Nothing in these Terms excludes your rights under the ACL. To the maximum extent permitted by law: (i) StoryCloud is not liable for indirect, incidental, or consequential damages; (ii) our total liability for any claim is limited to fees paid by you in thepreceding 12 months; (iii) nothing limits liability for death, personal injury, or fraud caused by StoryCloud’s negligence.
15. Indemnity
You agree to indemnify StoryCloud against claims, damages, or expenses arising from your misuse of the Services, violation of these Terms, or breach of applicable laws.
16. Termination
We may suspend or terminate your account if you: (i) breach these Terms; (ii) misuse the Services; (iii) fail to pay fees; (iv) provide false or misleading information. If termination is without cause, we will provide a pro-rata refund of prepaid subscription fees. Upon termination, we will delete or de-identify personal information per our Privacy Policy. Parents or centres may request export of data prior to deletion.
17. Changes to Terms
We may update these Terms from time to time. If material changes occur, we will notify you via email, in-app notice, or our website. Continued use after changes means you accept the updated Terms.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Australian Capital Territory, Australia. You agree to the exclusive jurisdiction of the courts of the ACT.
19. Complaints and Disputes
If you have concerns about the Services, please contact us via the channels listed on our website. If unresolved, you may escalate to:
the Australian Competition and Consumer Commission (ACCC) for consumer matters; and/or the Office of the Australian Information Commissioner (OAIC) for privacy matters.20. International Use
Our Services are currently available only in Australia. If we expand internationally, additional laws may apply (e.g., COPPA in the United States; GDPR in the European Union). We will update these Terms to reflect such changes.
21. Summary for Families
Accounts must be created by adults. Only first name, age, and usage data are collected from children.Parents or educators supervise all use. No ads, no public communication, no data selling.Parents can cancel at any time and can access, correct, or delete their child’s data.22. Learning Bundles and Technology
22.1 Ownership
The Device Bundle (e.g., iPad, rugged case, charger) is provided as managed learning infrastructure for educational use during the program term and remains StoryCloud property while the program is active.Devices are administered under MDM with security and content controls.Any device ownership option, if offered after completion, is discretionary and handled separately from enrolment and CCS. No ownership transfer is promised or guaranteed under these Terms.22.2 Care and Use
Parents, guardians, and centres must take reasonable care of devices and accessories.Devices are for educational use only. They must not be resold, jailbroken, or loaded with unauthorised software.Families and centres must not disable MDM or tamper with parental/centre controls.StoryCloud may apply configuration updates necessary for safety, compliance, or service quality.22.3 Damage, Loss, and Replacement
If a device is damaged beyond repair or lost, a replacement may be provided under StoryCloud’s hot-swap process and a replacement fee may apply in accordance with the current device policy and any applicable care plan.Repairs covered under the relevant manufacturer or service plan will be arranged by StoryCloud where applicable.Hot swaps will be processed as soon as reasonably practicable.22.4 Return of Devices
If a subscription ends before the program term is completed, or on request, all devices and accessories must be returned to StoryCloud in good working order (fair wear and tear accepted).Failure to return a device or accessories may result in a replacement fee up to the then-current replacement cost.
